General Terms & Conditions for Retail Customers

If you view any of the pages on this website and or place an order you are also agreeing to be bound by these terms and conditions, even if you do not register with us or order from us. If you do not accept these terms you should not use this website and you should not place any order with us by post, phone, fax or email, or in person. We may revise these terms and conditions at any time by updating this page.

Ordering

As part of our online checkout process you have the opportunity to check your order and to correct any errors before committing to buy. If you place an order online we will send you an order acknowledgement, detailing the products you have ordered. When goods are ordered by phone, fax or email you will be given an opportunity to review the items ordered and the total price to be charged will be stated. Our acceptance of your order takes place when we dispatch your order. The dispatch of your order brings into existence a legally binding contract between us. If your order was made online we will also send you a dispatch confirmation by email. We reserve the right to decline any order.

Payment

We will charge your credit or debit card upon receipt of your order (cheques will be deposited) unless delivery cannot be fulfilled within 30 days. We accept no liability if a delivery is delayed because you did not give us the correct payment details. Payment must be made before the goods are dispatched. If we are unable to obtain full payment for the goods or if we are unable to verify card or cardholder security details then we can cancel the contract and or suspend any further deliveries to you. We may insist that goods can only be delivered to the registered address for the credit or debit cardholder of the card used for payment. This does not affect any other rights we may have. All goods remain the property of Boat Electricals Limited until paid for in full including all taxes, carriage charges, insurance or other costs relating to the supply of those items.

Availability

All orders are subject to acceptance and availability. We have tried to ensure that, when shown, the stock availability information on our website is as up-to-date as possible. However, if any items you have ordered are not available from stock we will usually back-order them and contact you by e-mail or phone (if you have given us details). You will have the option either to wait until the back-ordered items are available, to choose an alternative item or to cancel your order.

Dispatch Times

Stock items will normally be dispatched within 24 hours (Monday to Friday). Any times given for dispatch, repair or replacement, are to be treated, as estimates only and time shall not be of essence of contract.

Delivery Arrangements

All orders are accepted on the basis that they will be delivered to you via our carriers. Items destined for mainland UK are generally delivered one or two working days after dispatch however delivery times are not guaranteed. Delivery charges will vary according to: sizes; weights; destination; type of goods; customer preferences; type of service; number of parcels. Calculated charges will also cover additional costs such as: packaging expenses; insurances; fuel surcharges; carrier collection charges. Orders for delivery to UK Highlands and Islands, Northern Ireland, the Channel Isles, the Isle of Wight, the Isle of Man, the Orkney Isles and the Shetland Isles etc. will usually take longer. We will deliver the goods to the address you specify for delivery on your order, so it is important that this address (especially the postcode) is accurate. A valid name and signature will be required on delivery and goods cannot be left unattended in sheds, outhouses, porches etc. If no one is available to receive the delivery goods at the specified address our carrier may leave a card giving a number to call to arrange for a later delivery or for you to collect the goods from the relevant depot. In the unlikely event that you have not received the goods within 3 days (6 days for remote areas) of the date of delivery given in our delivery email (unless we have informed you otherwise) you should notify us immediately. Cancellation & Returns

You may cancel your order up to 7 days following the day goods are delivered. Cancellation can be notified by post, fax or by email, or by phone in the case of orders placed by phone. If you have received the goods before you cancel your contract then you must send the goods back to the address shown above at your own cost and risk within 14 days. If you cancel your contract before the goods are delivered you must not unpack the goods when they arrive. We will refund the amount paid for the goods (including VAT) in full, as soon as possible but in any event within 30 days of cancellation PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or you do not pay the costs of return carriage or postage, we will be entitled to deduct the direct costs of recovering the goods.

Goods Damaged in Transit & Shortages

Goods damaged in transit, missing items or shortages should be notified by email, fax or telephone immediately or in any event within 48 hours of delivery. We will contact you with instructions about how to proceed. It is vital that you retain any damaged items and all packaging for later inspection by our insurers.

Faulty or Unsatisfactory Items

If you are unhappy or experience difficulties with any of our products or service, in the first instance please contact us in writing by email, fax or post, or in the case of orders placed by phone, also by phone. We will contact you with instructions about how to proceed. Do not return any goods without contacting us first and without obtaining a return authority number. All complaints will be acknowledged within 5 working days and treated with the utmost confidentiality.

If you have notified us of a problem with the goods, we will (subject to availability) either make good any shortage or non- delivery; replace or repair any goods that are damaged or defective upon delivery; or refund to you the amount paid by you for the goods in question. In the first instance, do not return any goods without first contacting us and without obtaining a return authority number.

Liability

Where we have agreed to collect goods, you confirm that you will keep the original goods safely and allow our nominated carrier to collect them from you without undue delay. Failure to allow the original goods to be collected may result in you incurring an additional charge. We will not be liable to you for any loss of profits, administrative inconvenience, disappointment, indirect or consequential loss or damage arising out of any problem in relation to the goods and we shall have no liability to pay any money to you by way of compensation other than any refund we make under these conditions. This does not affect your statutory rights as a consumer, nor is it intended to exclude our liabilities to you under the law. Goods supplied are not for resale. We shall have no liability to you for any failure or delay in supply or delivery or for any damage or defect to goods supplied or delivered hereunder that is caused by any event or circumstance beyond our reasonable control (including, without limitation, severe weather conditions, floods, accidents, strikes, lockouts and other industrial disputes). The goods are intended for use in the United Kingdom and we make no warranties, express or implied, that the goods are suitable for use outside the United Kingdom, or comply with any laws, regulations or standards of any jurisdiction outside the United Kingdom.

Termination

We may suspend further supply or delivery, stop any goods in transit or terminate our contract by notice in writing to you if you are in breach of any obligation within these terms and conditions or you become unable to pay your debts when they fall due or proceedings are commenced by or against you alleging bankruptcy or insolvency. Upon termination, your indebtedness to us becomes immediately due and payable and we shall be under no further obligation to supply goods to you.

VAT

Where goods are liable for VAT this will be charged at prevailing rates subject to changes in taxation.

Governing Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with English law. Disputes arising in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the English courts. It is prohibited to access the website from territories where its contents are illegal or unlawful. If you access this website from locations outside the United Kingdom, you do so at your own risk and you are responsible for compliance with local laws.

Miscellaneous

If any part of these conditions is invalid, illegal or unenforceable (including any provision in which we exclude our liability to you) the validity, legality or enforceability of any other part of these conditions will not be affected. This contract shall be governed by and interpreted in accordance with English law. You may not assign, sub-license or otherwise transfer any of your rights under these terms and conditions. If any provision of these terms and conditions is found by any court of competent jurisdiction to be invalid, the invalidity of that provision will not affect the validity of the remaining provisions which shall continue to have full force and effect.

Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission. We have taken care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been fairly described.
